Here Are Some Of The New California Laws Going Into Effect In 2023

The new year is right around the corner and there are a few changes happening in the state of California from minimum wage increasing to jaywalking to the pink tax. Below are some of the new laws that are going into effect on January 1, 2023:

  • Wage Transparency - businesses with 15 or more employees must include information for job postings salary ranges and businesses with over 100 employees must submit pay data and wage history to the state by May of each year.
  • Jaywalking - it's illegal for law enforcement to stop and cite someone for jaywalking unless they do so in an unsafe manner.
  • Pink Tax - aims to eliminate the "pink tax" by fining businesses up to $10,000 for violations where women are charged more than men on certain items.
  • Flavored Tobacco - prohibits sale of menthol and other flavored cigs along with flavored tobacco for vape pens which are said to be targeting teenagers.
  • Consumer Privacy - consumers and employees can ask businesses to disclose the personal information they've collected on them to be deleted or corrected.
  • Catalytic Converters - prohibits anyone from buying a catalytic converter other than from an automobile dismantler, an automotive repair dealer or person who provides documentation that they own the car piece.
  • Human Trafficking - law requires hair salons, nail salons, and any other barbering and cosmetology businesses to post signs that contain information about slavery and human trafficking.
  • Rap Lyrics - limits the use of rap lyrics as evidence in criminal trials.
  • Food Packaging - bans use of food packaging like take-out boxes and food wrappers made from plant fibers that contain PFAS
  • Street Vendors - mobile street vendors will be able to obtain permits and meet health requirements easier.
  • Holidays - three new state holidays are June 19 (Juneteenth), Lunar New Year, and April 24th will be known as Genocide Remembrance Day.
  • Abortion Protections, Confidentiality, Medical Information and Medical Licenses
  • Parking Requirements - prohibits local governments from setting a minimum vehicle parking space requirement on new residential or commercial development located within 1/2 mile of public transit.
  • Firearm Possession - prohibits anyone convicted of misdemeanor child abuse or elder abuse from possessing a firearm.
  • Gun Manufacturers Lawsuit - goes into effect in July and allows prosecutors or anyone who suffered from gun violence in Cali to sue firearm manufacturers for damages.
